The Democratic Party has requested an investigation into Irini Shehu, the director of the Dibra hospital, regarding the reconstruction of the Dibra hospital.

On April 19, 2023, the CA Directorate of the Dibër Regional Hospital announced the procedure with the object: "Reconstruction of the Dibër Regional Hospital "Rrahim Xhika", with a fund of 3.2 million euros. This reconstruction procedure with a limit fund with a very small difference with the reference price per square meter of new constructions in this area, was canceled due to the decision of KPP no. 716, dated 3.8.2023, which found, among other things,

that the contracting authority, through its actions, has acted in complete opposition to the rules of public procurement, but in order to reduce competition, so it has decided to propose to the Public Procurement Agency the initiation of an administrative investigation for all responsible officials.

During the election period of May 14 last year, the ministry advertised the reconstruction of the regional hospital of Dibra, stating that the project was ready and very soon the work for its complete rehabilitation would begin.

But in fact today after 18 months, not only did the work not start but it failed for an indefinite period.

Thus, on April 19, 2023, the CA Directorate of the Dibër Regional Hospital announced the procedure with the object: "Reconstruction of the Dibër Regional Hospital "Rrahim Xhika", with a fund of 3.2 million euros. This RECONSTRUCTION procedure with a limited fund with a very small difference with the reference price per square meter of new constructions in this area, was canceled due to the decision of the KPP no. 716, dated 3.8.2023, which stated, among other things:

That the contracting authority, through its actions, has acted in complete opposition to the rules of public procurement, but in order to reduce competition, so it has decided to propose to the Public Procurement Agency the initiation of an administrative investigation for all responsible officials.

On September 6, 2023, the CA Directorate of the Dibër Regional Hospital re-announced this procedure for which 10 bidders participated, and after the lowest bid was disqualified, a consortium of operators was declared the winner with a difference in price of 268 thousand euros (with VAT) with the lowest bid. This procedure was canceled again for the second time with the decision of the KPP no. 238/ 2024 Prot, dated 06.03.2024, which decided in addition to the cancellation:

6. To propose to the Public Procurement Agency, the initiation of the administrative investigation, for the violations committed by all responsible officials.

7. The copy of this decision, to be sent for notification to the Ministry of Health and Social Protection, the Ministry of State for Public Administration and Anticorruption, as well as the Network of Anti-Corruption Coordinators.

Although the KPP has instructed for the second time the cancellation of the procedure with violations written in black and white, repeated, only due to the fault of state officials, there is no official reaction to the criminalization of those responsible.

The head of the Contracting Authority Irini Shehu, at the same time the head of the Dibër municipal council, continues to arrogantly allow the violation of the law.

Who is responsible for the fact that the works are not being carried out in the Dibër Regional Hospital, this public work necessary for the citizens, which, although it was promised to start the works in the local elections of May 2023, has been delayed for 18 months due to the fault of state officials and it is not known how long will this delay continue?

The law on public procurement, article 21, point 5, as well as VKM, article 73, charges Irini Shehu with direct responsibility from the planning to the implementation of the contract, including the mismanagement of public funds.

The contracting authority or entity has the obligation to properly plan the public funds and its needs in quality and time and to procure and implement the contract in accordance with the legislation in force.

Under these conditions, the Democratic Party requests the prosecution to start the investigation for Irini Shehu and all other officials involved in the procurement process and found in violation by the Public Procurement Commission for:

Drafting of the file and setting of the qualifying criteria and technical specifications and not in function of the procurement procedure by limiting the competition as well as not guaranteeing the mandatory principles in the development of the public procurement procedures./ CNA
