Corruption in the physical control of vehicles/ Fier Prosecution issues security

The Fier Prosecutor's Office has issued security measures regarding a corruption case during a technical inspection of vehicles at the Fier Regional Service Directorate.

Specifically, the prosecution has imposed the measure "Compulsory appearance" on 7 officials of the directorate and 3 citizens.

They are charged with "Abuse of office", "Active corruption of persons exercising public functions", "Passive corruption of persons exercising public functions", and "Failure to report a crime".

The Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier issued security measures for ten people, including 7 officials of the Regional Directorate of the Regional Service in Fier for the criminal offenses of "Abuse of office", "Active corruption of persons exercising public functions", "Passive corruption of persons exercising public functions", and "Failure to report a crime", provided for by articles 248, 244/1, 259/1 and 25, and 300, of the Criminal Code.

In the framework of the investigations into criminal proceedings no. 1173, dated 14.09.2023, initiated on the basis of materials referred by the Fier Local Police Directorate, it resulted that there are reasonable suspicions that citizens AM, SK, MG, ES, JV, LM and E.Sh., employees of the Technical Control Center, at the Regional Directorate of Road Transport Service, Fier, during the exercise of their duties as technical control specialists, by actions and omissions, have passed the technical control of vehicles with technical defects that constitute a risk to road traffic, which contain elements of the criminal offense "Abuse of duty", committed in the aggravating circumstance "more than once", provided for by articles 248 and 50, letter "h", of the Criminal Code. 

There are also suspicions that the persons under investigation DH and J,.Q., in collaboration with each other, gave the amount of 2000 (two thousand) Lek to the employees of DRSHTRr, Fier, to pass the technical inspection of the vehicle of the citizen under investigation JQ, which contains the elements of the criminal offense "Active corruption of persons exercising public functions", committed in collaboration, provided for by Article 244, paragraph 1, and 25, of the Criminal Code, as well as the criminal offense "Passive corruption of persons exercising public functions", provided for by Article 259/1 of the Criminal Code.

The investigation also revealed that the citizen under investigation DN, during a telephone conversation, offered an irregular benefit of unspecified value to the citizen under investigation JV, an employee of the Technical Control Center, at DRSHTRr, Fier, for the procedure of passing the technical control of a vehicle. The citizen under investigation JV passed the vehicle and did not report this crime to the criminal prosecution authorities.

Within the framework of this criminal case, a security measure was requested and a security measure was imposed for ten persons under investigation, as follows:

- The imposition of security measures "Obligation to report to the judicial police", provided for by Article 234 of the Code of Criminal Procedure, and "Suspension of the exercise of a public duty or service", provided for by Article 242 of the Code of Criminal Procedure, against the persons under investigation AM, SK, ES, MG, LM and E.Sh., as suspects of committing the criminal offense "Abuse of office", committed more than once, provided for by Articles 248 and 50, letter "h", of the Criminal Code.

- Assigning the security measure "Obligation to report to the judicial police", provided for by Article 234 of the Code of Criminal Procedure, to the person under investigation JV, suspected of committing the criminal offense "Abuse of office", committed more than once, provided for by Articles 248 and 50, letter "h", of the Criminal Code, as well as the criminal offense "Failure to report a crime", provided for by Article 300 of the Criminal Code

- The imposition of the security measure "Obligation to report to the judicial police", provided for by Article 234 of the Code of Criminal Procedure, against the persons under investigation DH and JQ, suspected of committing the criminal offense "Active corruption of persons exercising public functions", committed in collaboration, provided for by Articles 244, paragraphs 1 and 25 of the Criminal Code.

- The imposition of the security measure "Obligation to report to the judicial police", provided for by Article 234 of the Code of Criminal Procedure, against the person under investigation DN, suspected of committing the criminal offense "Active corruption of persons exercising public functions", provided for by Article 244, paragraph 1, of the Criminal Code.

In addition, the Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier expresses its commitment to the priority investigation of groups of offenses related to corruption and abuse of office./ CNA
