Former Minister of Justice, Eduard Halimi, reacted today regarding Sunday's tragic accident, which took the lives of two children and injured another.
Through a post on social media, Halimi states that the harsh laws in the Criminal Code should be implemented without mercy, for such shocking cases for everyone.
According to Halimi, the impunity of those who kill behind the wheel must be addressed without any form of tolerance and in an exemplary manner without compromise.
"Two children killed by a drunk in Durrës: The toughened laws in the Criminal Code must be implemented without mercy!"
A terrible accident in Durrës shocked us all!
Yesterday, a drunk driver hit three innocent children on the sidewalk. The result: two children dead and another in serious condition (fortunately out of danger according to the latest news).
There are no words that can describe the parents' pain.
Even though I have not been in active politics for 9 years, as a parent and as a former Minister of Justice, I feel compelled to speak out. I have been and remain critical of the impunity of those who kill behind the wheel.
In 2013, I proposed and we managed to approve, amidst much debate, the harsh criminal package, Law No. 144/2013, which brought important changes to the Criminal Code:
Article 290 – For perpetrators like yesterday who cause death or serious injury to several people, the sentence was raised to 20 years in prison (the same as for murder with a weapon). The minimum of 5 years makes the difference.
Article 291 – Driving while intoxicated was aggravated to 3 years in prison.
Unfortunately, just a year later (Law 98/2014), Article 291 was partially softened and reverted to a fine.
If that mitigation hadn't been made, a drunken recidivist might have been in jail yesterday, not behind the wheel. Maybe this accident would have been prevented, maybe not.
But our job as politicians is to create laws that reduce the possibility of such tragedies. However, even the strictest law without implementation remains only on paper.
The deterrent effect comes from strict enforcement, continuous monitoring, awareness-raising, and uncompromising exemplary punishment.
