SPAK closes the investigations/ Sends the file for the OPGJ officer and 2 others

SPAK has completed the investigations for OPGJ officer, Fatbardh Lala, and two other people, Tefta Llagaçi and Ermir Llagaçi. 

According to the investigations carried out by SPAK, Ermir Llagaçi and Tefta Llagaçi, in cooperation with each other, having a common goal, and carrying out related actions between them, gave the monetary amount of 55,000 ALL to the officer of the Judicial Police , Fatbardh Lala, as the latter has vouched for them and assured them that he could exert influence on the officials of justice, which are the prosecutor and the judge, who had the criminal case in charge of the person in the investigation and further in the trial under investigation, Ermir Llagaçi.

For this reason, the defendant Fatbardh Lala has been accused of having committed the criminal offense of "Exercising illegal influence on persons exercising public functions", provided by article 245/1 paragraph IV I of the Criminal Code.

The Special Prosecutor's Office against Corruption and Organized Crime in Tirana has completed the preliminary investigations, and submitted to the Special Court of First Instance for Corruption and Organized Crime, the request for trial of criminal proceedings no. 180, of 2022, with defendant citizens:

Fatbardh Lala, accused of the criminal offense of "Exercising illegal influence on persons exercising public functions" and "Disclosure of acts or secret data" provided by articles 245/1 paragraph IV and 295/a paragraph III of the Criminal Code Criminal.

Tefta Llagaçi, accused of the criminal offense "Exercise of illegal influence on persons exercising public functions", carried out in cooperation, provided by article 245/1 paragraph 2 and 25 of the Criminal Code.

Ermir Llagaçi, accused of the criminal offense "Exercise of illegal influence on persons exercising public functions", committed in cooperation, provided by article 245/1 paragraph 2 and 25 of the Criminal Code.

At the end of the preliminary investigation, the evidence obtained is able to prove, beyond any reasonable doubt, that the defendants Ermir Llagaçi and Tefta Llagaçi, in cooperation with each other, having a common goal, and carrying out related actions between they have given the monetary sum of 55,000 lek to Judicial Police Officer Fatbardh Lala, as the latter has vouched for them and assured them that he could exert influence on the officials of justice, which are the prosecutor and the judge, who have had investigation and further in the trial, the criminal case in charge of the person under investigation Ermir Llagaçi, consuming in this way the criminal offense "Exercise of illegal influence on persons exercising public functions", carried out in cooperation, provided by article 245/1 paragraph 2 and 25 of the Criminal Code.

At the same time, the evidence obtained is able to prove, beyond any reasonable doubt, that the defendant Fatbardh Lala, acting as a Judicial Police Officer, at the Prosecutor's Office of the First Degree of General Jurisdiction, Tirana, received/accepted the sum of 55,000 ALL , from the co-defendants Llagaçi, promising you that he will exert illegal influence, using his duty as a Judicial Police Officer.

For this reason, the defendant Fatbardh Lala has been accused of having committed the criminal offense of "Exercising illegal influence on persons exercising public functions", provided by article 245/1 paragraph IV I of the Criminal Code.

In addition, the defendant Fatbardh Lala, by extracting data related to criminal proceedings related to the citizen Ermir Llagaçi, such as the name of the prosecutor, the criminal offense, etc., has consumed the criminal offense provided for by Article 295/a, third paragraph of Criminal Code. This is because he has discovered data containing the secret acts of one or more criminal proceedings, and he has this information by accessing his work offices as a Judicial Police Officer, at the Prosecutor's Office of the First Degree of the General Jurisdiction Tirana.

He transmitted these data to the co-defendant Tefta Llagaçi, over the phone, even recommending that the prosecutors should meet. These actions were carried out in violation of the rules of his work, in violation of investigative secrecy in relation to the cases in question, as long as the prosecutors of the case had not taken open actions with the citizen Ermir Llagaçi, in this way infringing the regular functioning of the bodies of justice, and the principle of investigative secrecy, and for this reason he has been accused of having committed the criminal offense "Disclosure of secret acts or data", provided by article 295/a paragraph III of the Criminal Code./ CNA
