New industrial law "closes the door" to espionage/ Business secrets,

Industrial espionage will no longer go unpunished. With the entry into force of the new industrial law, trade secrets and undisclosed information become a legal red line, the violation of which brings serious financial and legal consequences.

The law establishes a clear protection regime for businesses and innovators, targeting any unlawful gain, use or disclosure of confidential information.

"Anyone who benefits from an industrial secret, knowing or having the duty to know that the action is illegal, will be held fully liable," the report states, without specifying the 'punishment'.

An innovation was the approximation of the legal framework in line with CEFTA standards, which specified that the injured party gains the right to seek full compensation for the damage suffered.

"The authorities will force the offender to pay not only economic losses and lost profits, but also any unfair advantage realized from the illegal act. When necessary, the calculation of damages also includes moral damage and damage to the reputation of the secret keeper," the report of the draft law, which is currently under consideration in the Assembly, said.

When determining damages, the law requires that all relevant factors be taken into account, including:

• negative economic consequences for the injured party,
• lost profits as a result of the infringement,
• any unfair advantage realized by the infringer,
• as well as non-economic elements, such as moral prejudice and damage to reputation, where these are applicable. /Monitor
