Attempted murder of Durim Bami/ SPAK closes investigation, brings 6 defendants

The Special Prosecution Office has closed the investigations and sent the case file for 6 defendants for trial.

SPAK has sent the case to court against Albert Zaja, Edison Muceku, Elvis Ndreca, Armando Ndreca, Deivis Bajramaj and Adrian Pikl.

The defendant is accused of a number of serious criminal offenses.

Among the charges is the attempted murder of Durim Bami.

6 defendants sent for trial for serious criminal offenses

The Special Prosecution Office against Corruption and Organized Crime (Special Prosecution Office) has completed the preliminary investigations of criminal proceedings no. 59/2, of 2022, by submitting to the Special Court of First Instance for Corruption and Organized Crime:

 

I. The request for sending the case to trial in favor of the defendants:

 

Albert Zaja, accused of:

"Murder in other qualifying circumstances", against two or more persons, attempted, resulting in the injury of citizens Durim Bami and Ervin Kodra, within the framework of a structured criminal group (Articles 79/dh, 22 and 28/4 of the Criminal Code);

"Providing conditions and material means to commit murder", to the detriment of citizen Hamza Terziu (Articles 80 and 28/4 of the Criminal Code);

“Illegal possession of weapons and ammunition”, in collaboration within the framework of a structured criminal group (articles 278/1 and 28/4 of the Criminal Code);

“Structured criminal group” (Article 333/a/2 of the Criminal Code);

“Committing criminal offenses by a criminal organization” (Article 334 of the Criminal Code).

Edison Muceku, arrested in the United Kingdom on 10.01.2025 and extradited to Albania on 28.03.2025, accused of:

"Providing conditions and material means to commit murder", to the detriment of citizen Hamza Terziu (Articles 80 and 28/4 of the Criminal Code);

“Structured criminal group” (Article 333/a/2 of the Criminal Code);

“Committing criminal offenses by a criminal organization” (Article 334/1 of the Criminal Code).

Elvis Ndreca, accused of:

"Providing the conditions and material means to commit murder", to the detriment of citizen Durim Bami (Articles 80 and 28/4 of the Criminal Code);

“Structured criminal group” (Article 333/a/2 of the Criminal Code);

“Committing criminal offenses by a criminal organization” (Article 334/1 of the Criminal Code).

 Armando Ndreca, accused of:

“Production and sale of narcotics”, within a structured criminal group (articles 283/3 and 28/4 of the Criminal Code);

“Structured criminal group” in the form of organization (Article 333/a/1 of the Criminal Code);

“Committing criminal offenses by a criminal organization” (Article 334/1 of the Criminal Code).

 Deivis Bajramaj, accused of:

“Unauthorized possession of weapons and ammunition”, in the form of trading and sale (Articles 278/6 and 28/4 of the Criminal Code);

"Structured criminal group" in the form of creation, management and organization (Article 333/a/1 of the Criminal Code);

“Committing criminal offenses by a criminal organization” (Article 334/1 of the Criminal Code).

 Adrian Pikli, arrested in Germany on 17.05.2024 and extradited on 16.07.2024, accused of:

“Unauthorized possession of weapons and ammunition”, in the form of trading (articles 278/6 and 28/4 of the Criminal Code);

“Structured criminal group” (Article 333/a/2 of the Criminal Code);

“Committing criminal offenses by a criminal organization” (Article 334/1 of the Criminal Code).

Dynamics of the investigated events:

 

From the entirety of the investigative actions carried out so far, it is proven that:

 

04.11.2020, Ura e Tapizës, Fushë Krujë – Albert Zaja dhe persona të tjerë tentuan të vrisnin me armë zjarri shtetasit Durim Bami dhe Ervin Kodra.

maj–korrik 2020 – Albert Zaja dhe Edison Muceku siguruan mjetet për vrasjen e shtetasit Hamza Terziu.

korrik–gusht 2020 – Elvis Ndreca siguroi mjetet për vrasjen e shtetasit Durim Bami.

tetor 2020 – Armando Ndreca organizoi dhe financoi grupin që prodhoi dhe shiti 243 kg kanabis në Lezhë.

2020–2021 – Deivis Bajramaj dhe Adrian Pikli u përfshinë në tregtinë e paligjshme të armëve dhe municioneve, duke i shitur edhe personave me precedent penal.

II. Kërkesën për pushimin e çështjes në lidhje me procedimin penal Nr.59/2 të vitit 2022, në ngarkim të të pandehurve:

 

Silvio (Roland) Cara, akuzuar për kryerjen e veprave penale të:

“Vrasje me paramendim”, në dëm të shtetasit Shkëlzen Kastrati, ngjarje e ndodhur në datën 01.02.2021 në qytetin e Fierit, kryer në formë të veçantë të bashkëpunimit, atë të grupit të strukturuar kriminal, kryer në formë të veçantë të bashkëpunimit, atë të grupit të strukturuar kriminal;

“Mbajtja pa leje dhe prodhimi i armëve, armëve shpërthyese dhe i municionit”;

“Grup i strukturuar kriminal”, në formën e pjesëmarrjes, parashikuar nga neni 333/a, paragrafi 2 i Kodit Penal;

“Kryerja e veprave penale nga organizata kriminale dhe grupi i strukturuar kriminal”, të parashikuar nga neni 334/1 i Kodit Penal.

“Falsifikimi i dokumenteve” të parashikuar nga nenet 186/1 të Kodit Penal;

Elmir Tufa, akuzuar për kryerjen e veprave penale të:

“Vrasje me paramendim”, në dëm të shtetasit Shkëlzen Kastrati, ngjarje e ndodhur në datën 01.02.2021 në qytetin e Fierit, kryer në formë të veçantë të bashkëpunimit, atë të grupit të strukturuar kriminal, kryer në formë të veçantë të bashkëpunimit, atë të grupit të strukturuar kriminal;

“Mbajtja pa leje dhe prodhimi i armëve, armëve shpërthyese dhe i municionit”;

“Grup i strukturuar kriminal”, në formën e pjesëmarrjes, të parashikuar nga neni 333/a, paragrafi 2 i Kodit Penal;

“Kryerja e veprave penale nga organizata kriminale dhe grupi i strukturuar kriminal”, të parashikuar nga neni 334/1 i Kodit Penal.

Nga tërësia e veprimeve hetimore të kryera deri më tani, provohet se në lidhje me të pandehurit Silvio Cara dhe Elmir Tufa, hetimet në Prokurorinë e Posaçme në ngarkim të tyre kanë vazhduar pas shpalljes së moskompetencës lëndore më dt.30.05.2024 të procedimit penal nr. 103 dt.01.02.2021 të Prokurorisë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm Fier.

Nga aktet hetimore provohet se më datë 01.02.2021, rreth orës 10:00-11:00, në lagjen “Sheq i Madh”, Fier, te vendi i quajtur “rrotontua e Sheqit” është vrarë me armë zjarri shtetasi Shkëlzen Brahim Kastrati, i cili ka qenë duke udhëtuar me mjetin tip Benz me targa AA 871 AN.

Nga hetimet e kryera nga Prokuroria e Posaçme, referuar bisedave të realizuara nga përdoruesit e SkyEÇ të zhvilluara mes anëtarëve të një grupi të strukturuar kriminal, ka dalë në pah organizimi i këtyre shtetasve me qëllim realizimin e vrasjes së shtetasit Kelmend Kastrati, por kanë lajthitur në objekt dhe kanë vrarë shtetasin Shkëlzen Kastrati.

Gjatë hetimit janë evidentuar personat e interesuar dhe porositës, si dhe personat që janë angazhuar për lokalizimin e këtij shtetasi dhe ekzekutorët, ku njëri nga ekzekutorët është dënuar për këtë ngjarje me vendim penal të formës prerë nr. 62-2023-1137 (160), datë 04.04.2023, të Gjykatës së Rrethit Gjyqësor Fier.

The investigation failed to prove that the defendants Silvio (Roland) Cara and Elmir Tufa were associates of this structured criminal group and had participated in the commission of criminal offenses.

In accordance with Articles 328, point 1, letter "dh" and 329/a of the Code of Criminal Procedure, the Special Prosecution requested before the judge of the preliminary hearing the dismissal of the criminal case against the defendants Silvio (Roland) Cara and Elmir Tufa, in relation to criminal proceedings no. 59/2 of 2022, as it was not proven that the criminal offenses for which they are accused were committed by these defendants.

For the other members of the structured criminal group identified or unidentified by us, involved in the murder with a firearm on 01.02.2021 of citizen Shkëlzen Kastrati, preliminary investigations are continuing in relation to criminal proceeding no. 59 of 2022, from which criminal proceeding no. 59/2 of 2022 has been separated./ CNA
