SPAK gives the details from the investigations for 5D/ Directors of Veliajt

The Special Prosecutor's Office against Corruption and Organized Crime has completed preliminary investigations for criminal proceedings no. 75/2 dated 02.12.2024 and no. 75/3 dated 02.12.2024, registered for the criminal offense "Violation of the equality of participants in tenders or public auctions", carried out in cooperation.

From the investigative actions carried out in connection with these criminal proceedings, the evidence was collected and the fact was proven that the commercial company "5D Konstruksion" sh.pk (the same as the company named "VAS Konstruksion" sh.pk), which was owned indirectly from the citizens Redi Molla and Mariglen Qato, former officials in the capacity of the General Director and the Director of the Directorate in the institutions under the Municipality of Tirana have benefited from public contracts in violation of the rules of public procurement by the authorities contractors "Tirana Parking" and "Tirana Sports Club".

First, from the investigations carried out, it has been proven that the defendant Deborah Keçi, in the capacity of the holder of the contracting authority "Sports Club Tirana", an institution subordinate to the Municipality of Tirana, in cooperation with the defendants Teuta Guri, Jetjon Mera and Rejnaldo Gjerazi, in the quality of the members of the Bid Evaluation Committee have created unfair advantages and privileges for the economic operator "5D Konstruksion" sh.pk in the procurement procedure with object "Wrestling Gym Reconstruction" held on 09.12.2020.

From the evidence collected during the investigations, it has been proven that the defendant Deborah Keçi, in the capacity of the holder of the contracting authority, agreed with the representative of the economic operator "VAS Konstruksion" sh.pk to declare it the winner of the procurement procedure from the preparation stage. of documents, the procedure has not yet been announced.

The defendants Teuta Guri, Jetjon Mera and Rejnaldo Gjerazi, in their capacity as members of the Bid Evaluation Commission, did not exercise their duty to evaluate and classify offers in accordance with the law, but evaluated and classified them in violation of the procurement rules public economic operator "5D Konstruksion" sh.pk, which has been predetermined to be declared the winner by the defendant Deborah Keçi.

Secondly, from the investigative actions carried out during the preliminary investigations, the fact has been proven that the defendant Eglantina Zere, in the capacity of the holder of the contracting authority "Tirana Parking", an institution subordinate to the Municipality of Tirana, in cooperation with the defendants Enkelejda Qyta, Bruno Koçi and Rivjola Baxha, in the capacity of members of the Bid Evaluation Committee (KVO), as well as with the defendant Kristo Zhulati in the capacity of a member of the Procurement Unit have created unfair advantages and privileges for the merger of the winning economic operators "VAS Konstruksion sh.pk" and "Rroku Guest" sh.pk, in the procurement procedure with the object "Reconstruction of the parking lot at Selman Stermasi", held on 01.10 .2019.

The evidence collected during the investigations fully proves the fact that the verification and evaluation of the offers of the economic operators who participated in this procurement procedure were not done by the members of the KVO, but by other persons who worked in the company "5D Konstruksion" s.pk

It has been proven that the members of the Bid Evaluation Commission did not perform their duties for the evaluation and classification of bids in accordance with the law, but evaluated and classified in violation of the rules of public procurement the union of economic operators "VAS Konstruksion" sh. pk and "Rroku Guest", who were predetermined to be declared the winner by the defendant Eglantina Zere.

On 06.01.2025, the Special Prosecutor's Office filed in the Special Court of First Instance for Corruption and Organized Crime in Tirana, the request for sending to trial criminal case no. 75/2 of 2024 against the defendants:

Deborah Keçi, accused of the criminal offense "Violation of the equality of participants in public tenders or auctions", committed in collaboration, provided by articles 258 and 25 of the Criminal Code (according to the content of this provision before the changes made by law no. 43/2021, dated 23.03.2021).

Teuta Guri, accused of the criminal offense "Violation of the equality of participants in public tenders or auctions", committed in cooperation, provided by articles 258 and 25 of the Criminal Code (according to the content of this provision before the changes made by law no. 43/2021, dated 23.03.2021).

Rejnaldo Gjerazi, accused of the criminal offense "Violation of the equality of participants in public tenders or auctions", carried out in cooperation, provided by articles 258 and 25 of the Criminal Code (according to the content of this provision before the changes made by law no. 43/2021, dated 23.03.2021).

Jetjon Mera, accused of the criminal offense "Violation of the equality of participants in public tenders or auctions", carried out in collaboration, provided by articles 258 and 25 of the Criminal Code (according to the content of this provision before the changes made by law no. 43/2021, dated 23.03.2021).

Likewise, on 07.01.2025, the Special Prosecutor's Office filed in the Special Court of First Instance for Corruption and Organized Crime in Tirana the request for sending to trial the criminal case no. 75/3 of 2024 against the defendants:

Eglantina Zere, accused of the criminal offense "Violation of the equality of participants in public tenders or auctions", committed in cooperation, provided by articles 258 and 25 of the Criminal Code (according to the content of this provision before the changes made by law no. 43/2021, dated 23.03.2021).

Rivjola Baxha, accused of the criminal offense "Violation of the equality of participants in public tenders or auctions", committed in cooperation, provided by articles 258 and 25 of the Criminal Code (according to the content of this provision before the changes made by law no. 43/2021, dated 23.03.2021).

Enkelejda Qyta, accused of the criminal offense "Violation of the equality of participants in public tenders or auctions", committed in cooperation, provided by articles 258 and 25 of the Criminal Code (according to the content of this provision before the changes made by law no. 43/2021, dated 23.03.2021).
