SPAK sends the lawyer to court, accusations of corruption

The Special Prosecutor's Office against Corruption and Organized Crime in Tirana has completed the preliminary investigations and sent the lawyer Petraq Semani to court.

He is accused of having committed the criminal offense of "Exercising illegal influence on persons exercising public functions", provided for by article 245/1, second paragraph of the Criminal Code (before the amendments by law no. 43/2021).

From the entirety of the acts and evidence administered during the investigation, it is proven beyond reasonable doubt based on facts and evidence that the defendant Petraq Semani, as the legal defender of the citizen Llazar Dine, has asked the citizens Llazar Dine and Sidorela Dine for the monetary amount of 25,000 euros , after he promised that he would exert influence on the judges who were considering the case in charge of the citizen Llazar Dine, to favor the convicted Llazar Dine in terms of the sentence during the retrial of the case.

The illegal profit was received from the defendant Petraq Semani in parts and one of these parts was received on 05.03.2019, in the residence of the citizen Llazar Dine in the village of Dërsnik Korçë, after the court session of that date, this fact was proven not only by the statements of citizens Llazar Dine, Sidorela Dine and OD, but this moment was also accepted by the defendant Petraq Semani himself, stating that this meeting took place on this date and that he received the amount of 9,550 euros, but according to him, this amount was taken for the service provided as a lawyer.

The receipt of the monetary sum of 9,550 euros by the defendant Petraq Semani in the residence of the citizen Llazar Dine was recorded with audio and video by the family and social circle of the citizen Llazar Dine, this recording dated 03.05.2019 and then on 03.06.2019 it was also uploaded to the memory card, which was seized as material evidence after it was submitted by citizen Sidorela Dine. The video-audio material was reviewed and its content was documented in the review minutes dated 05.10.2021.

The recorded images and their content also match the data obtained from other evidence administered during the investigation (such as the statements of the PD and OD citizens, the inspection of the place of the event - the residence of the citizen Llazar Dine, the inspection of the court file, etc.) .

Court of Korçë Judicial District, with decision no. 41-2020-543(91), dated 11.02.2020, declared the defendant Llazar Dine guilty of committing the criminal offense of "Intentional grievous bodily harm resulting in death", provided for by Article 88/2 and 25 of the Criminal Code sentencing him to 15 (fifteen) years in prison (in the same amount of punishment as he was sentenced the first time by decision no. 10, dated 08.01.2018, of the Korçë Judicial District Court).

From the amount obtained illegally, the defendant Petraq Semani returned the sum of 8,000 euros to the citizen Sidorela Dine.
