The Special Prosecutor's Office against Corruption and Organized Crime is conducting investigations within the framework of criminal proceedings with no. 190, of 2023.

From the entirety of the procedural actions carried out up to this stage of the preliminary investigations for the account of this criminal proceeding, a real estate of the residential apartment type located in Lungomare, Vlorë, has been identified as an asset related to the person under investigation IB By court decision the control of this property was allowed in July 2024, from which data of interest for the investigation were obtained.

This property or the expenses/investments made for its furnishing do not turn out to have been declared according to the legislation in force by the person under IB investigation or the persons related to him.

From the totality of the investigative actions carried out, we list the following facts:

In 2016, with the order contract concluded between the construction company R...K... shpk and the citizen IF, the apartment was booked in the amount of 6,700,000 (six million and seven hundred thousand) ALL.

In 2017, the investment and furnishing of the apartment started by the person under investigation IB and his wife, a process which lasted until the beginning of 2019. According to the appraisal report, the total value invested is up to 5,064,700 (five million sixty-four thousand seven hundred) ALL.

In February 2020, a lease contract was signed between citizen IF (close social connection of IB) and AB (wife of IB). Despite this fact, it turned out that the person under IB investigation and his family members freely possessed the property and behaved as owners of the immovable property until the beginning of 2019.

All these facts in their entirety prove the existence of reasonable doubt on the fictitiousness of the legal action, with the aim of hiding the origin of the property.

Based on the above facts, the Special Prosecutor's Office Against Corruption and Organized Crime, based on Article 274 of the Code of Criminal Procedure, has requested the Special Court of First Instance for Corruption and Organized Crime to establish the property security measure "preventive sequestration" ” to the above property.

The Special Court of First Instance for Corruption and Organized Crime with Decision No. 539, dated 20.09.2024, decided:

Acceptance of the request of the Special Prosecutor's Office against Corruption and Organized Crime;

The determination of the property insurance measure "preventive sequestration", provided by article 274 of the Code of Criminal Procedure, on the real estate (apartment), with an area of ??90.8 m2, a veranda area of ??61.2 m2 and a common area of ??13.7 m2, located in Lungomare, Vlora, as property related to the person under IB investigation

The investigators of the National Bureau of Investigation, in cooperation with judicial police officers at the Vlora Local Police Directorate, have carried out the execution of the Court's decision./ CNA
