Report for 2022/ Artur Metani: 41 magistrates were investigated

The High Inspector of Justice, Artur Metani, presented to the Committee for Legal Affairs the annual report of the institution's work during 2022.

Metani said that during 2022, 1715 complaints were handled, while priority was also given to old complaints.

He emphasized that the ILD will try to close the backlog of complaints, but noted that the lack of inspectors hinders the work.

" Obviously, the reporting period is for 2022, but I think it is important to report to you the fact that today the number of backlogs is 345 complaints, and at the rate we are going, we think that by the end of the 6 months we will remove and the issue of backlogged complaints. By the end of the year, we are trying to remove the complaints of 2020-2021, we succeeded because the lack of resources in the inspectorate is taking its toll , he said.

Regarding disciplinary investigations, the High Inspector of Justice said that he has approved 28 decisions for the investigation with 41 magistrates.

" Referring to these legal provisions, during the year 2022 the High Inspector of Justice, after ascertaining the existence of reasonable suspicions, approved 28 decisions for the disciplinary investigation, through which the alleged violations against the activity of 41 magistrates were investigated. The disciplinary investigation for 3 subjects has been started on initiative, for 38 subjects on the basis of complaints.

The results of the investigation are as follows:

· for 6 magistrates10 (3 judges and 3 prosecutors) requests for proceedings were submitted to the respective councils;

· for 1 magistrate (1 judge) the investigation has been suspended until a final decision on the re-evaluation process is made;

· for 22 magistrates (20 judges and 2 prosecutors) the disciplinary investigation was closed due to: i) the end of the magistrate's status; ii) assessment of the facts, circumstances investigated and evidence obtained, as insufficient to prove the alleged violations.

· for 14 magistrates (13 judges and 1 prosecutor) of the disciplinary investigation, the investigative procedures are in progress ", he declared.

Metani said that 4 thematic inspections were carried out, such as the inspection for casting lots in the courts, the division of cases in the prosecutor's office, the procedure for clarifying them, especially in Tirana, and the procedure for replacing prosecutors.
