Chela counts crimes under "Laws"/ No word on mafia murders

Prosecutor General Olsian Çela is reporting to the Law Commission on the state of criminality for 2022.

Çela only spoke with numbers about the criminal cases that were registered, while he did not say a word about the mafia murders that occurred in 2022.

" Throughout 2022, at all levels of prosecutors' offices of general jurisdiction, the creation of temporary and permanent vacancies has continued up to 42% of prosecutors (temporary reassessment). Despite the problems created by these marked deficiencies in the organic, the prosecutors of general jurisdiction have responsibly exercised their powers based on the Constitution of the Republic of Albania, international agreements ratified by law, codes and laws in the field of criminal justice, recommendations of constitutional institutions (recommendations of the Assembly and the Council of Ministers) and international, as well as in the priorities of the Albanian state that derive from the process of integration with the European Union.

MAIN INDICATORS ACCORDING TO THE STAGES OF CRIMINAL PROCEEDINGS

1. Indicators of preliminary investigations, crimes/misdemeanors, their weight and trends

-During 2022, the prosecution body in the preliminary investigations handled 61114 materials under review, which is an increase of 0.16% compared to 2021. A total of 48315 criminal proceedings were followed, which is an increase of 1.69% in compared to 2021, of which there are 25,737 criminal proceedings registered, with a decrease of 9.27% ??compared to 2021, and 695 criminal proceedings resumed, which shows a decrease of 26.06% compared to 2021. 21883 criminal proceedings were carried out with an increase of 20.21% compared to the proceedings carried out in 2021. It was decided not to start the proceedings for 12799 referrals and criminal reports, with a decrease of 5.21% compared to 2021.

The largest number of proceedings was registered by the Prosecutor's Office at the Court of First Instance in Tirana with 33.88% of the total number of proceedings registered nationwide or with a 2.57% increase in this ratio compared to 2021.

- In 2022, Berat district has the lowest crime rate per 100,000 inhabitants, while Gjirokastër district has the highest rate. As for the trend, it is observed that Shkodër district has the highest increase with 10.64%, while Berat district has a crime rate below the national average, which results in a decrease of 25.09% compared to 2021.

-The report on the division of criminal offenses (crimes and misdemeanors), based on the statistics of 2022, results that 79% of criminal proceedings belong to crimes and 21% belong to criminal misdemeanors or compared to the year 2021 of this report, with an increase of 0, 23% of criminal proceedings and a decrease in criminal misdemeanor proceedings.

- Regarding the ratio of groups of offenses according to the structure of the Criminal Code with the total number of proceedings registered by the prosecution for 2022, among the group of criminal offenses with the highest number of proceedings registered, it is evident that - criminal offenses against order and security public offenses constitute the highest number of registered criminal proceedings with 29.45% of the total number of registered proceedings, which has a decrease of 7.53% compared to 2021. Property theft criminal offenses constitute 26.16% of the number of total number of registered proceedings, which decreased by 14.87% compared to 2021; -criminal offenses against children, marriage and family by 6.08%, which have an increase of 4.89% compared to 2021; - criminal offenses that violate the legal regime of land by 5.05%, which have a reduction of 33, 

2. The filing and representation of the charge in court and the execution of criminal decisions

-During the year 2022, charges were filed and represented in court on behalf of the state by the prosecutor's offices at the first instance courts for 11,006 cases (an increase of 4.75% compared to 2021) with 12,958 defendants (an increase of 4.90% compared to 2021), which constitute 66.87% of the total number of cases in relation to dismissed cases. Also, 13,138 requests for the determination of personal insurance measures were submitted to the court (with a decrease of 9.84% compared to 2021).

-In 2022, the execution of 9,146 final criminal court decisions was ordered in the prosecutor's offices near the courts of first instance (17.84% decrease compared to 2021), 4,897 criminal decisions were executed and 3,806 decisions remained unexecuted. which according to the type of punishment", said Çela, among other things.
