Gang lawyer calls for justice reform
Star Manjani

In a statement that also constitutes an analysis to "save" justice in Albania, lawyer Ylli Manjani, also known as the gang lawyer, has given his lectures on the reform that the country needs.

"I have supported and will always support the idea of ??a real justice reform," Manjani said.

According to him, the justice system urgently needs a complete redesign, starting with the liberation of the courts from politics and ending with the life experience of judges.

"We need a fair system, not a permanent Nuremberg. Okay, let's have SPAK after all, but not special courts. Investigations are special, but not trials and courts," he declared.

“The more special a court is, the more dictated it is.” A bold statement, especially coming from someone who knows very well how “special systems” work from the inside.

His statement did not spare the Xhafaj Commission, which he said only aims to “patch up the current mess” and “close the loopholes .” This would be ironic considering that these very “loopholes” may have been the salvation of many of his clients.

Indirectly, Manjani expresses that he agrees with the "Xhafaj" Commission, a commission which, since its creation, aimed to attack SPAK.

Apparently, for the lawyer, the "Xhafaj Commission" would be a salvation for him and his clients, because it could easily bring them "clean" of crimes, and he openly admits this, saying that "I would completely agree with this reform, in these terms, even if it were undertaken by the so-called "Xhafaj Commission."

In the end, for all those who wonder how it is possible for such a figure to seek pure justice, there is only one answer: perhaps it is simply an attempt to protect his future clients, in a “fairer” system.

Ylli Manjani's full statement:

"I have supported and will always support the idea of ??a real justice reform.
I am not about to waste time destroying what happened, but rather building a fair justice system. I believe that real justice reform should have a major goal:
To make the court independent. To free it from the pressure of the prosecution and from political influence.
We are no longer going anywhere with special courts and trials. There can be no fair system in the "permanent Nuremberg".
Okay, let's have SPAk after all, but not special courts. Investigations are special, but not trials and courts. The more special the court, the more dictated it is. We are no longer going anywhere with judges whose careers are upside down and without guarantees. We must ensure that judges have life experience, in addition to their professional ones. Careers do not start in the high courts. Even a fixed-term appointment is no guarantee of independence. (See the fur and the leaves of the Kuahtetuesa court (what do they do with a debate on mandates)...
In this sense, we will need to reconceptualize the judicial system to make it independent in a guaranteed and secure way. On the other hand, rewriting the procedural codes to reduce ambiguity and guarantee due process in all senses of the word is an immediate task.
The freedom and rights of everyone are guaranteed only by a fair process and equal procedures for everyone. We need a new Criminal Code, which establishes proportionality in punishment and does not necessarily criminalize every human behavior.
So I am for a real Albanian reform. We already have a lot of experience. At least we know what should no longer be done. With this reform, in these terms, I would completely agree, even if the so-called "Xhafaj Commission" undertook it.
But I doubt that we have the same understanding and purpose.
I suspect that the Xhafaj Commission is maximally aiming to patch up the current mess to close some temporary hole. If that's the case, we certainly don't have meeting points." /CNA
