Received $25,000 to influence judges to commute a sentence, the Special Court has ordered "house arrest" for the lawyer with the initials PS

From the investigations it was found that the lawyer with the initials PS, asked and received from the citizens Ll. D. and S. D, a monetary sum of 25,000 (twenty-five thousand) Euros, after he promised to exert influence on the judges of the case, who were considering the case in charge of the citizen Ll. D., for his favor in terms of punishment.

The Special Prosecutor's Office Against Corruption and Organized Crime in Tirana has registered criminal proceedings No. 257, of 2021, for the criminal offense of "Exercising illegal influence on persons exercising public functions", provided by article 245/1/2 of the Criminal Code.

In the analysis of the investigative actions carried out up to this moment, it turns out that the citizen SP, in the capacity of a lawyer, has asked and received citizens Ll. D. and SD, a monetary sum of 25,000 (twenty-five thousand) Euros, after he promised to exert influence on the judges of the case, who were considering the case in charge of the citizen Ll. D., for his favor in terms of punishment.

Receiving the amount of 9,550 (nine thousand five hundred and fifty) Euros, from the person under investigation SP, in the residence of the citizen Ll. D. was recorded with audio and video from the family and social circle of citizen Ll. D., this registration is dated 06.03.2019. While the rest of the requested amount, according to the statements of the citizen SD, related to the statements of other citizens who have knowledge of the criminal offense, and the data of the Western Union, was given later in several installments, until the final decision during the retrial phase in the first instance.

Court of the Korçë Judicial District, with decision no. 41-2020-543(91), dated 11.02.2020, declared the defendant Ll. D. for committing the criminal offense of "Deliberate grievous bodily harm, resulting in death", provided for by article 88/2 e 25, of the Criminal Code and sentenced to 15 (fifteen) years of imprisonment, (in the same amount of punishment as it was convicted the first time by decision No. 10, dated 08.01.2018, of the Korçë Judicial District Court). From the amount obtained illegally, the citizen under investigation SP returned to the citizen SD, the amount of 8000 (eight thousand) Euros, while he did not return the rest.

As above, based on the investigations carried out in the framework of this criminal proceeding, it turns out that there are reasonable doubts based on evidence that the citizen of SP has consumed elements of the criminal offense "Exercising illegal influence on persons exercising public functions". provided for by article 245/1, second paragraph of the Criminal Code (before the amendments by law no. 43/2021).

At the request of the Special Prosecutor's Office, the Special Court of First Instance for Corruption and Organized Crime, with decision no. 15, dated 18.02.2024, decided:

The assignment of the coercive measure of personal security "House arrest", provided by article 237 of the Penal Code, to the citizen SP, investigated for the criminal offense "Exercising illegal influence on persons exercising public functions", provided from article 245/1, second paragraph of the Criminal Code (before the changes with law no. 43/2021).

The above measure was executed by the judicial police services of the General Directorate of the State Police, on 19.02.2024.

Clarification: Security measures are part of the criminal prosecution exercise. Everyone is presumed innocent until proven guilty by a final court decision. /CNA
