The Special Prosecutor's Office against Corruption and Organized Crime in Tirana has completed the preliminary investigations and has submitted to the Special Court of First Instance for Corruption and Organized Crime, the plea agreement request, of criminal proceedings No. 288, of 2021, in charge of the defendants:

Zenel Çela, accused of committing the criminal offense "Violation of equality of participants in public tenders or auctions", provided for by Article 258 of the Criminal Code (investigated in a free state);

Ramiz Bardhi, accused of committing the criminal offense "Violation of equality of participants in public tenders or auctions", provided by article 258, of the Criminal Code (investigated in a free state);

Rexhep Ismajlisufaj, accused of committing the criminal offense "Violation of equality of participants in public tenders or auctions", provided for by Article 258 of the Criminal Code (investigated in a free state);

Criminal procedure No. 288, of 2021, was registered on the basis of the predicate material referred by the High State Control. The object of the investigation of this criminal proceeding was the procedure followed by the contracting authority Tropoja Municipality, in the public procurement with the object "Asim Vokshi School-Gym and sports grounds and external systems in the Asim Vokshi Gymnasium", with a limited fund of ALL 50,319,591. without Tvsh, open procedure type.

From the analysis of the evidence and data collected in the function of the investigation of this criminal proceeding, it is proven that the defendants, with their actions as members of the Bid Evaluation Committee, during the evaluation of the bids, have not treated equally economic operators participating in the procurement procedure with the object "Asim Vokshi School", Tropoje Municipality.

Although the Union of Economic Operators "Halili 1 & Shendelli" has submitted the lowest bid in the amount of ALL 42,072,833, excluding VAT, the defendants as members of the Bid Evaluation Committee, in violation of the Law and Public Procurement Rules , as well as with the criterion established in the Standard Tender Documents, have announced the winner of the economic operator "4 AM", with the offer of 50,269,533 ALL without VAT, causing an economic damage in the amount of 8,196,700 ALL (as the difference between the two offers) .
