Consecutive violations of Ilir Beqajt/ GJKKO: Fictitiously increased

Important details have emerged from the decision of GJKKO on the sterilization affair, where the former Minister of Health, Ilir Beqaj, is also accused.  

According to GJKKO, Ilir Beqajn has fictitiously increased the costs of sterilization in the items for this service. In 2013, figures over 283 million new lek, which went to the purchase of health materials and medicines, were introduced.

GJKKO also emphasizes that Ilir Beqaj, in his capacity as Minister of Health, allowed the concession, causing great financial damage to the state, while if the sterilization center had been put into operation, it would have cost less to the public budget.

134. With letter No. 842/3 Prot., dated 26.05.2022, sent by the University Trauma Hospital, regarding the supply of the trauma operating block with the medical materials and medications of the attached list for this operating block, it is noted that SaniService does not supply the trauma operating block with none of the required medical supplies and medications.

134. The above shows that the amount of 283, 287, 369.55 ALL, entered as an item of the cost of sterilization of surgical sets for the HCW for the year 2013 and calculated in the value of the total cost of the HCW of 502, 233, 399 ALL (sheet 92 of the Feasibility Study), it turns out that it is not a cost for the sterilization of surgical instruments, but it is the cost of supplying medicines and medical materials WHICH IS NOT PART OF THE SERVICE GIVEN WITH THE CONCESSION. The above-mentioned Feasibility Study data have been sent to the Ministry of Finance with letter No. 3082/8 dated 10.10.2014 of the Minister of Health.

135. Also, with letter No. 3082/16 Prot., dated 17.12.2014, the Minister of Health has been sent additional information for the granting of the Concession, where it is explained that in the feasibility study the annual cost of this service procured only in QSUT was taken into consideration (see Appendix 2, Argumentation for Granting the Concession). Meanwhile, the feasibility study (see Appendix 2, Public Sector Comparator) proves that with the provision of the PPP service, the costs for all the country's hospitals are almost equal to the current annual costs only for QSUT". Attached to this letter are the appendices, including Appendix 2 "Argumentation for granting the Concession and budgetary implications". The value of 283, 287, 369.55 allek results to be 56.4% of the total value of 502, 233, 399 allek calculated for the QSUT for the year 2013 (referred to and described in sheet 92 of the Feasibility Study). The cost of the service at QSUT for the year 2013 was calculated as half of this service for the whole country, since QSUT had almost half of the 50,000 surgical interventions that the whole country had.

- In the specific case, the person under IB investigation in the capacity of the Minister of Health has allowed the granting of a concession in the amount of 9,657,000,000 (without VAT) for a 10-year term, while according to the Supreme State Control if the Sterilization Center with modern equipment was put into use, the cost for 10 years would be 960,000,000 ALL. So, there is a reasonable suspicion that the person under IB investigation intentionally caused damage to the state budget in the amount of 8,697,000,000 Lek (9,657,000,000 – 960,000,000). This is the consequence assuming that the value of the contract would be as much as was initially announced at the beginning of the procedure, since as will be analyzed below the value of the concession contract is not known for sure, because during the development of the procedure the value of the contract changed from the value total in the amount of 9,657,000,000 (without VAT) in an indicative value, where it is not known how much the cost of the concession will be at the end of the 10-year period"./ CNA
