The Special Prosecutor's Office against Corruption and Organized Crime in Tirana has conducted investigations within the framework of criminal proceedings no. 07 of 2023, for the criminal offenses "Exercise of illegal influence on persons exercising public functions", and "Crime prevention", provided by articles 245/1, points 2 and 4 and 300 of the Criminal Code.

From the investigations carried out up to this stage of the investigation, reasonable suspicion has been created that the citizens of DK, NH, NJ, BK and AK, in cooperation with each other, have consumed the elements of the criminal offense of "Exercising illegal influence on persons who exercise public functions" in the form of seeking the irregular benefit of an amount of 5000 (five thousand) euros in order to exert influence on the Court of Appeal Korçë to mitigate the security measure of the citizen BK, who was investigated for the criminal offense provided by Article 298 of the Criminal Code. The DT citizen is suspected of having committed the criminal offense of "Discrediting the crime", provided for by Article 300 of the Criminal Code.

Based on the request of the Special Prosecutor's Office against Corruption and Organized Crime in Tirana, the Special Court of First Instance for Corruption and Organized Crime, with decision No. 137 dated 25.12.2023, among other things, decided:

1. The appointment of the measure of personal security "Arrest in prison", provided by article 238 of the Criminal Code, to the person under NH investigation, suspected of committing the criminal offense "Exercising illegal influence on persons exercising public functions ", carried out in collaboration, provided by article 245/1/2-25 of the Criminal Code.

2. The appointment of the measure of personal security "Arrest in prison", provided by article 238 of the Criminal Code, to the person under investigation by the Criminal Code, suspected of committing the criminal offense "Exercising illegal influence on persons exercising public functions ", carried out in collaboration, provided by article 245/1/2-25 of the Criminal Code.

3. The assignment of the measure of personal security "Arrest in prison", provided by article 238 of the Criminal Code, to the person under investigation NJ, suspected of committing the criminal offense "Exercising illegal influence on persons exercising public functions ", carried out in collaboration, provided by article 245/1/2-25 of the Criminal Code.

4. The assignment of the measure of personal security "House arrest", provided by article 237 of the Penal Code, to the person under investigation DK, suspected of committing the criminal offense "Exercising illegal influence on persons exercising public functions ”, provided by article 245/1/4 of the Criminal Code (lawyer profession).

5. The assignment of the measure of personal security "Compulsion to appear before the judicial police", provided for by article 234 of the Criminal Code, to the person under investigation by the DT, suspected of committing the criminal offense "Disobedience of the crime". provided by article 300 of the Criminal Code.

6. Determination of the measure of personal insurance "Obligation to appear before the judicial police", provided for by article 234 of K. Pr. Criminal, against the person under investigation CA, suspected of committing the criminal offense "Exercising illegal influence on persons exercising public functions", carried out in cooperation, provided by article 245/1/2-25 of the Criminal Code.

The Special Prosecutor's Office against Corruption and Organized Crime in Tirana has ordered the execution of security measures determined by decision No. 137 dated 25.12.2023 of the Special Court of First Instance for Corruption and Organized Crime and the General Directorate of the Police The State executed these insurance measures on 25 and 26.12.2023.
