However, the Special Anti-Corruption Structure is convinced that Mirel Mërtiri is, at least, the actual owner of the company "Albtek Energy", the private company that won the concession contract for the construction of the Elbasan landfill and incinerator, worth over 22 million euros.

The company was owned by his cohabitant, Stela Gugallja. For SPAK, the real owner is Mirel Mërtiri, for whom 10 years of imprisonment was requested for the charges of "active corruption of high officials" and "cleaning of the proceeds of criminal offences".

The conviction of the special prosecutors on the leading role of Mirel Mërtir has been established, after they secured a dozen electronic communications between him and other persons connected to the incinerator companies.

"From these communications it is proven that the defendant Mirel Mërtiri is the person who directs the affairs of the company "Albtek Energy" sh.pk as well as the person who actually has the decision-making powers in this commercial company and is known by other people as the manager and representative of this society", it is stated in the SPAK file, seen by "Boldnews.al".

Below are listed some of the main findings of SPAK regarding the role of Mirel Mërtir in the company "Albtek Energy".

- During the investigations, the contract dated 27.11.2014 between the company "Albtek Energy" sh.pk and the company "Energy Recuperator" spa, based in Italy, with representative Ernesto Granelli, was administered, which has as its object the "turnkey" construction of "Incinerator with electric power", in Elbasan.

In this contract, which is in Italian, but was also translated into Albanian during the investigations, it is found that the name of the contracting party, the company "Albtek Energy" sh.pk, was written and then the company's e-mail address was set. Attached to this e-mail are the documents with the name "Financial management for Albtek Energy" with works items in the amount of 16,000,000 Euro, as well as the document with the name "Financial forecast for the realization of works", which refers to the same works as the first document , but with different prices, where the total price is in the amount of 21,661,000 Euros. When asked about this e-mail, citizen Ilirjan Priftaj explained that he sent it to the three persons above.

From the examination of the data extracted from the computer technical expertise acts, - says SPAK, - several communications by means of electronic mail carried out by the defendant Mirel Mërtiri with other persons, from which his leadership role is proven and owner in the activity of the company "Albtek Energy" sh.pk

- On 13.03.2016, the defendant Mirel Mërtiri sent an email to the defendant Klodian Zoto, related to the construction process of the Elbasan incinerator boiler. Attached is another e-mail from ing. Ernesto Granelli, with content related to the work process at the construction site. In this e-mail, the defendant Mirel Mërtiri wrote to the defendant Klodian Zoto that: "Good afternoon, please give a written answer to this trash that we cannot accept because they are in Chinese. They have to close the work according to the ER schedule in February... Question: who is lying ER or ER.. Kill yourself... Those with the following written ER are not admitted or if they want to be admitted, the fine is 5000 euros per day for each day of delay from March 1st…. Answer them as soon as possible... Have a good day".

- On 14.12.2016, the defendant Mirel Mërtiri sent an e-mail to the defendant Klodian Zoto, with the content "Ok... let's go". This e-mail turns out to be a response to another previous e-mail of the defendant Klodian Zoto , who in turn sent a letter in draft form, unsigned, prepared in the name and account of the company "Integrated Technology Services", represented by Klodian Zoto, addressed to the Veneto Bank, where it is described that this company expresses its good will for solving a complicated situation with the Veneto Bank.

- On 19.12.2016 the defendant Mirel Mërtiri was sent an e-mail from the company "De Mare" srl, administrator Fausto De Mare, where in parallel the e-mail was also sent to the defendants Klodian Zoto and Sevi Zani, with content: "For Albtek Energy sh.pk, for the attention of Mr. Mirel Mërtiri, for the information of av. Klodian Zoto, for the information of Sevi Zani. Good day Mirel, I am sending the attached as high as possible to the object. I would be very happy if you could send me the bank guarantee as soon as possible. Together with this e-mail, several documents were sent, where there is a draft for a bank guarantee from the Albtek Energy company, as well as an invoice from the De Mare company.

- On 17.03.2017, the person named Julia Muça, identified as a finance specialist, sent an e-mail to the defendant Mirel Mërtiri, in which she wrote that: "Please, below I am sending you some payments as the most urgent, in in case of non-payment, problems may arise:", where the payments to be made are also described, in the total amount of 1,949,664 ALL.Next, in the e-mail it is described that: "ITW balance 950,000 ALL; state ALB 10,000,000; state ITS 180,000; Zoto cash balance 1,490,000 ALL". In the content of the email, the companies are described by initials, where ITW means Integrated Technology Waste, ALB means the company Albtek Energy, and ITS means Integrated Technology Services. On 17.03.2017, the defendant Mirel Mërtiri, sent the above e-mail received from the citizen Julia Muça to the defendant Klodian Zoto, where he wrote the following: "Zoto, please let them do what Elbasan will start today. Have a nice day".

- On 23.03.2017, the citizen Julia Muça sent the defendant Mirel Mërtiri an e-mail with the content: "Hello, Isufi needs a loan, can you confirm the value please, FLM, the loan here is 150,000". The defendant Mirel Mërtiri responded by writing that: "Give him as much as he needs".

- On 13.05.2017, the person named Klevis Dine sent an e-mail to the citizen Julia Muça, as well as to the defendant Stela Gugallja, in which he informs them that on 13.05.2017 the guard at the landfill gate was found asleep by the operators of the night and that he was confronted with them . He further writes that the working day for May 13 should be removed. The e-mail was sent by Julia Muca to the defendant Mirel Mërtiri, who replied that: "Three days of work should be taken from him and not just one... I'm giving Biles the notice tomorrow... Tell the staff to remind me tomorrow morning" .

- On 17.05.2017, the defendant Mirel Mërtiri sends an e-mail to the defendant Klodian Zoto, as well as to citizens Sevi Zani and Helada Papa. Attached is the e-mail sent by a person named Andrea to the defendant Mirel Mërtiri, in which a draft document is forwarded. The defendant Mirel Mërtiri wrote to the defendant Klodian Zoto as follows: "Good morning, Klodi and Goca, please read it and send me on a sheet what needs to be corrected...".

- On 21.07.2017, the defendant Mirel Mërtiri sent an email to the defendant Klodian Zoto, related to the construction process of the Elbasan incinerator. Attached is another e-mail that was sent to the defendant Mirel Mërtiri on 20.07.2017, in the Italian language that was translated into the Albanian language during the investigations, in which the problems related to the work program are presented. The defendant Mirel Mërtiri wrote to the defendant Klodian Zoto as follows: "Are these trashes okay??? Please a very Strong response today and warn PW to cut off all relations until all issues with EL are sorted out ….”.

- On 26.07.2018, the defendant Mirel Mërtiri received an e-mail from citizen Elton Bualli with the address "[email protected]", who explained that he was contacted by an environmental inspector, who together with the AKU, they needed to deposit animal waste near the Elbasan landfill and asked the defendant how they should act. The defendant Mirel Mërtiri replied that: "Don't accept it in any way, or 80 euros Tony, so that you have the opportunity to close the costs for the clay and all the other work that needs to be done... For me, don't accept it". This answer was also sent to the defendants Klodian Zoto and Stela Gugallja.
