Gent Ibrahimi: Real political battles are taking place in the name of the
Gent Ibrahimi, member of the Constitutional Court

The member of the Constitutional Court, Gent Ibrahimi, in the speech held today in the Assembly hall, said that genuine political battles are being fought in the name of the Constitution, while some of those who have approved this fundamental document of the state are still active in political life.

" Most of those who were protagonists in the process of approving the constitution are still an active part of social political life, many eyes are with us here today, but it must be said that not all of them contributed to the adoption of the constitution and everyone is expected to respect it without any equivocation that but where lies the difficulty? The fact that the process of approving constitutions is a political exercise cannot be overlooked. Politics in a democracy is never monolithic. The objective need to represent different social layers and interests combined with the need to gain political superiority in the elections causes the different wings of politics to be placed in antagonistic positions between them, thus making it difficult to approve the Constitution and often the issues under discussion turn into issues of genuine political struggles placing the protagonists in competing positions with each other. As a result, not everyone identifies with the Constitution in the same capacity" - said Ibrahimi.

The member of the Constitutional Court did not fail to mention the fact that approval by referendum is more suitable for constitutional changes.

" This is a problem when it comes to the applicability of the Constitution. Approval by referendum is more political in nature and more appropriate in cases of initial approval of the Constitution, while voting in parliament presents advantages when amendments like the one in 2016 are more technical in nature Albania's political stability has been strengthened and this is dedicated to the constitution and the way it is adopted," Gent Ibrahimi said.

Earlier in her speech, the president of the Constitutional Court raised the concern of the involvement of politics in the courts. / CNA
