Public contracts, 10 economic operators remain excluded from tenders

Updated official data show that there are currently 10 economic operators excluded from participating in public procurement procedures.

The list published periodically through the bulletins of the Public Procurement Agency (APP) shows that the exemptions have been set for different periods, ranging from 5 months to 2 years and have started in different phases from November 2024 to November 2025.

Businesses included in the “black list” are excluded for different periods of time, depending on the violations found and the relevant decisions of the PPA. The legal framework in force provides that economic operators may be excluded from public tenders for periods ranging from several months to several years, based on procedures and verifications carried out by the agency.

The Public Procurement Agency has previously emphasized, in its annual activity summaries, that decisions on exclusion are taken after analyzing the PPA's own audit reports, as well as as a result of proposals from contracting authorities, economic operators or other auditing institutions, in the exercise of their legal functions.

The main cause of the exclusions is related to misinformation and the submission of documentation with false data in tender procedures, contrary to the provisions of the public procurement law. In some cases, operators have been penalized for misinformation in order to qualify the contracting authority, while in other cases for submitting false documents during the stages of the procedure.

Complaints and measures can also be taken when operators do not respect the deadlines for fulfilling contracts to which they committed with the contracting authorities at the beginning of the process. In addition to official communications with institutions, the PPA also analyzes and takes into account complaints that may come to its address directly./ Monitor.al
