Unauthorized construction and abuse of office/ Fier Prosecution sends seven

The Fier Prosecutor's Office has closed the investigations and sent seven officials to court for illegal construction and abuse of office. According to the Prosecutor's Office's announcement, in October last year, 7 cases of illegal construction were identified in the Mallakastër Municipality. In some cases of illegal construction, it turned out that the relevant inspection structures and assistant specialists in the area were aware of the illegal construction and did not exercise their responsibilities according to the law.

The investigations also proved that the chief inspector and two inspectors at the Mallakastër IMT did not exercise their functional duties in 7 cases of unauthorized construction. Although they were made aware of the existence of these cases, they did not exercise their duties according to the law. Among the 7 persons are also 3 assistant specialists/SPZ, at the Mallakastër Police Commissariat, because they did not exercise their functional duties in the control, recording and identification of unauthorized constructions, although they were aware of the constructions.

PROSECUTOR'S NOTICE

The Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier completed the investigations and sent seven officials to trial for the criminal offenses of 'Illegal Construction' and 'Abuse of Office', provided for by articles 199/a, paragraphs 1 and 4 and 248 of the Criminal Code.
At the end of the investigations of criminal proceedings no. 1665, dated 21.10.2024, 7 cases of unauthorized construction by various citizens of the Mallakastër Municipality were identified. These citizens were mainly provided with preliminary declarations for carrying out works and then carried out constructions that required equipment with a construction permit. In some cases of unauthorized constructions, it turned out that the relevant inspection structures and Assistant Specialists in the area were aware of the unauthorized constructions and did not exercise their responsibilities according to the law.
The investigation proved that the chief inspector and two inspectors at the IMT of the Mallakastër Municipality did not exercise their functional duties in 7 cases of unauthorized constructions. Although they were informed of the existence of these constructions in some cases, they did not exercise their functional duties according to Law No. 9780, dated 16.7.2007 “On the inspection and protection of the territory from illegal constructions”, Law No. 107/2024 “On the planning and development of the territory”, as well as the by-laws issued in their implementation, charging them with responsibility according to Article 248 of the Criminal Code.
Also, failure to exercise responsibilities under Law No. 108/2014 “On the State Police”, and the by-laws issued in its implementation, was also evidenced for 3 Assistant Specialists/SPZ, at the Mallakastër Police Commissariat, specifically citizens YK, IB, DY. It turned out that these citizens did not exercise their functional duties in the control, recording and identification of unauthorized constructions, although they were aware of them. Their knowledge resulted from the written acts obtained during the investigation.
At the end of the investigations, 7 citizens were taken into custody as defendants and respectively:
1- Y. K with the duty of former Assistant Specialist/SPZ, at the Mallakastër Police Commissariat for committing the criminal offense “Abuse of duty”, provided for by article 248 of the Criminal Code.
2- I. B, former Assistant Specialist/SPZ, at the Mallakastër Police Station, for committing the criminal offense “Abuse of duty”, provided for by article 248 of the Criminal Code.
3- DJ, former Assistant Specialist/SPZ, at the Mallakastër Police Station, for committing the criminal offense “Abuse of duty”, provided for by article 248 of the Criminal Code.
4- A. X, former Chief Inspector at the Territory Protection Inspectorate of the Mallakastër Municipality, for committing the criminal offense “Abuse of duty”, provided for by article 248 of the Criminal Code.
5- Sh. Xh with the duty of inspector at the Inspectorate of Territory Protection, Mallakastër Municipality, for committing the criminal offense “Abuse of duty” provided for by article 248 of the Criminal Code.
6- K. Y with the duty of inspector at the Inspectorate of Territory Protection, Mallakastër Municipality, for committing the criminal offense “Abuse of duty”, provided for by article 248 of the Criminal Code.
7- LM, for committing the criminal offense “Illegal construction” provided for by article 199/a pg.4 of the Criminal Code.
