The Special Board of Appeal, KPA announced on Tuesday, May 14, the decision to terminate the vetting of former prosecutor Pelivan Malaj without a final decision, with the argument that the object and purpose of this process has become impossible. This decision comes after the High Council of Prosecution, KLP decided on April 17 to retire the Malay prosecutor, a few days before his appeal was to be examined in the College.

Prosecutor Pelivan Malaj was dismissed in 2021 by KPK for lack of financial resources, false declaration and two cases of conflict of interest. Malaj appealed the decision to the KPA and at the same time asked the KLP to extend his retirement age – which enabled him to receive 70% of his salary for another three years while he was suspended from office. He benefited from the extension of the retirement age by three years in September 2022, when he reached the age of 67.

After the KPA announced the date of the session to be held on April 22, the KLP urgently accepted another request of Malaj for his retirement, a decision that was taken in a bypass of the procedures. As a result, the end of the status of the magistrate for this prosecutor was also declared. The procedure for the retirement of Malaj was debated at the April 17 meeting among the members of the KLP.

On April 22, when Malaj's appeal had to be considered, the KPA panel chaired by Rezarta Schuetz, with Sokol Çomo as relator and Albana Shtylla, Ina Rama and Natasha Mulaj as members, decided with a majority of votes to accept his request for the postponement of the session. Even the decision to end the re-evaluation process for Malaya without a final decision was taken by a majority of votes by the KPA judicial body./ Reporter.al
